These Terms & Conditions (“Terms”) govern the use of VYBE Creative Media’s (“VYBE”, “we”, “us”, or “our”) website and the purchase or use of our services.
By requesting, booking, purchasing, or using any VYBE service, the client (“Client”, “you”, or “your”) agrees to these Terms.
VYBE Creative Media provides creative, digital, media, and related services, including but not limited to:
Social Media Management
Graphic Design
Video Production
Video Editing
Photography & Videography
Studio Rental
Presenter Services
Website Design & Development
WordPress Development and Maintenance
Digital Marketing
Content Creation
Branding and Creative Services
The exact scope of each project will be based on the agreed quotation, package, proposal, invoice, or written communication between VYBE and the Client.
All quotations and prices provided by VYBE are based on the scope of work discussed with the Client.
A quotation may include:
Service charges
Production charges
Editing charges
Presenter fees
Studio rental
Travel charges
Third-party costs
Applicable taxes or other charges, where relevant
Additional work or requirements outside the agreed scope may be charged separately.
Quotations are subject to change before project confirmation if the scope, requirements, or costs change.
A project, booking, or service will be considered confirmed once:
The Client accepts the quotation or agreed proposal; and
The required advance payment has been received.
VYBE may decline to commence work until the required payment and necessary project information have been received.
Unless otherwise agreed in writing, a 50% advance payment is required before commencing a project or confirming a booking.
The remaining balance must be paid according to the payment terms stated in the quotation, invoice, or agreement.
For certain services, VYBE may require full payment in advance.
VYBE will provide the services according to the agreed scope.
Any request that is outside the original scope may be considered additional work.
Additional work may include:
Extra designs
Additional videos
Additional revisions
Major changes to an approved concept
Additional pages or website functionality
Additional shooting hours
Additional studio hours
Additional presenters
Additional travel
Additional content or campaign requirements
Additional charges will be communicated to the Client where applicable.
The Client is responsible for providing accurate and timely:
Text and written content
Logos and brand assets
Images and videos
Product/service information
Website content
Social media access
Required approvals
Other materials necessary for the project
VYBE is not responsible for delays caused by incomplete, inaccurate, or late information provided by the Client.
Unless otherwise agreed in writing, VYBE retains ownership of its original creative concepts, working files, templates, source files, project files, and internal production materials.
Final deliverables supplied to the Client may be used according to the agreed purpose and service.
Editable/source files such as:
Adobe Illustrator files
Photoshop files
Premiere Pro project files
After Effects project files
Raw video footage
Other working files
are not automatically included unless specifically agreed.
Third-party assets such as stock images, music, fonts, plugins, templates, or other licensed materials may be subject to separate licensing terms.
The Client confirms that they have the necessary rights, permissions, and authority to provide any content, images, videos, logos, music, documents, or other materials supplied to VYBE.
The Client is responsible for claims arising from materials provided by the Client that infringe third-party rights.
The number of revisions included in a project will depend on the agreed package or quotation.
A revision means a reasonable modification to the agreed concept or deliverable.
A complete change of concept, direction, script, design, or project requirements may be considered additional work.
Once the Client approves a final design, video, website, or other deliverable, further changes may incur additional charges.
Client approvals may be provided through email, WhatsApp, social media messages, or other agreed communication methods.
VYBE will make reasonable efforts to complete projects within the agreed or estimated timeline.
Project timelines may be affected by:
Delayed client feedback
Missing content
Delayed approvals
Changes in project scope
Technical issues
Third-party delays
Unforeseen circumstances
A new timeline may be agreed where significant delays occur.
For studio bookings:
The booking time is reserved specifically for the Client.
Clients should arrive on time.
Late arrival may reduce the available shooting time.
Additional time is subject to availability and may incur additional charges.
Studio equipment and facilities must be used responsibly.
Damage caused by the Client or members of their team may result in additional charges.
Rescheduling is subject to availability and the applicable cancellation policy.
For production services:
The final output will depend on the agreed creative brief and production requirements.
Location, lighting, weather, technical conditions, talent availability, and other external factors may affect production.
Additional shooting time, locations, equipment, presenters, or crew may incur additional charges.
Raw footage is not included unless specifically agreed.
Where VYBE provides a presenter:
Presenter fees will be based on the agreed duration, requirements, and project scope.
Presenter availability must be confirmed before booking.
Additional shooting time may incur additional charges.
Presenter replacement or rescheduling is subject to availability.
For Social Media Management services:
The agreed package determines the number and type of content to be produced or managed.
Posting schedules may depend on timely Client approvals.
VYBE does not guarantee specific follower numbers, reach, engagement, leads, sales, or other business results.
Social media platforms may change their algorithms, policies, features, or advertising systems without notice.
Content requiring Client approval may be delayed if approval is not provided on time.
Where VYBE manages paid advertising campaigns:
Advertising budgets paid to platforms such as Meta, Google, TikTok, or other advertising providers are separate from VYBE’s service fees unless specifically stated otherwise.
VYBE can manage campaigns according to the agreed strategy but cannot guarantee specific advertising results.
Platform policies, algorithm changes, account restrictions, rejected advertisements, or technical issues may affect campaign performance.
The Client is responsible for ensuring that advertising claims and business information supplied to VYBE are accurate and lawful.
For website-related services:
The project scope will be based on the agreed quotation or proposal.
Hosting, domain registration, premium plugins, themes, third-party services, and other external costs may be charged separately.
The Client is responsible for providing required website content and information.
Website performance may depend on hosting providers, third-party plugins, APIs, browsers, and other external services.
VYBE is not responsible for failures caused by third-party services outside its reasonable control.
Cancellation and refund matters are governed by VYBE’s Return, Refund & Cancellation Policy.
The Client acknowledges that advance payments may be non-refundable where VYBE has already started work, allocated resources, reserved studio time, booked personnel, purchased third-party services, or incurred other project-related costs.
Nothing in these Terms is intended to remove any rights available to the Client under applicable Sri Lankan law.
If the Client fails to make a required payment on time:
VYBE may pause work or delivery.
Project timelines may be extended.
Access to certain services may be suspended.
Additional costs may apply where agreed.
VYBE may withhold final deliverables until outstanding payments have been settled.
VYBE will take reasonable steps to keep confidential business and project information provided by the Client that is not publicly available.
Confidential information may be disclosed where required by law or where reasonably necessary to provide the agreed services through trusted service providers.
Unless the Client specifically requests otherwise in writing, VYBE may display completed work created for the Client in its portfolio, website, social media pages, presentations, or promotional materials.
Where a project contains confidential information or the Client has requested confidentiality, VYBE will respect the agreed confidentiality requirements.
VYBE may use third-party platforms, software, hosting providers, payment services, stock libraries, advertising platforms, or other external services.
VYBE is not responsible for changes, interruptions, outages, pricing changes, account restrictions, or failures caused by third-party providers.
VYBE will take reasonable care when providing its services.
To the extent permitted by applicable law, VYBE will not be responsible for indirect or consequential losses arising from the use of our services, including loss of profits, business opportunities, data, or revenue caused by circumstances outside VYBE’s reasonable control.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
VYBE will not be liable for delays or failure to perform services caused by circumstances beyond reasonable control, including:
Natural disasters
Power failures
Internet or network failures
Government restrictions
Strikes or disruptions
Serious technical failures
Emergencies
Illness or accidents
Third-party service outages
Other unforeseen circumstances
Where reasonably possible, VYBE will work with the Client to reschedule or provide an alternative solution.
Either party may request termination of an ongoing service arrangement subject to the applicable agreement, package terms, notice requirements, and outstanding payments.
Upon termination, the Client remains responsible for payment for services already completed and approved work or costs already incurred.
Personal information collected by VYBE is handled according to our Privacy Policy.
By using our services, you acknowledge that you have read and understood the applicable Privacy Policy.
VYBE reserves the right to modify its services, pricing, packages, website content, and these Terms from time to time.
The Terms applicable to a specific project will generally be the Terms agreed or communicated when the project is confirmed.
These Terms shall be interpreted in accordance with the applicable laws of Sri Lanka.
Any disputes will be addressed through reasonable communication and negotiation where possible, without limiting any rights or remedies available under applicable law.
By requesting, booking, purchasing, or using VYBE Creative Media’s services, the Client confirms that they have read, understood, and agreed to these Terms & Conditions.
Where a separate quotation, proposal, invoice, agreement, or service-specific terms conflict with these Terms, the specific written agreement may take precedence for that particular service or project.
